OVERVIEW
Welcome to Cluethers!
Cluethers is an independent leather goods business based in London, United Kingdom, offering a carefully selected collection of leather handbags, jackets, wallets, belts, berets and accessories.
Throughout these Terms of Service, the terms "we", "us" and "our" refer to Cluethers.
Our online store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products to customers.
These Terms of Service explain the conditions that apply when you access our website, purchase our products or use our services.
Please read them carefully before placing an order.
Nothing in these Terms limits or excludes your statutory rights under applicable UK consumer protection legislation.

Cluethers is responsible for the products sold through this website and for fulfilling orders placed directly with us.
SECTION 2 — ACCESS AND ACCOUNT INFORMATION
You may browse our website without creating an account.
When purchasing products, you may be required to provide information including your name, email address, billing details, delivery address and payment information.
You agree to provide accurate and up-to-date information to help us process and deliver your order.
If you create an account, you are responsible for taking reasonable steps to protect your login credentials and notifying us if you believe your account has been accessed without authorisation.
Purchases must be made by individuals who are legally capable of entering into a contract or by a parent or guardian acting on their behalf.
We may restrict access to accounts involved in fraudulent, unlawful or harmful activity where reasonably necessary and permitted by law.
SECTION 3 — OUR PRODUCTS
Cluethers offers leather goods and accessories selected with attention to craftsmanship, quality and durability.
We aim to ensure that all product descriptions, photographs, materials, sizes, colours and prices are accurate.
However, colours may appear slightly different depending on your screen settings and device.
As leather is a natural material, individual products may display variations in grain, texture, markings and colour. Where relevant, these characteristics will be explained in our product descriptions.
Natural characteristics do not remove your legal rights if a product is faulty, not as described or not of satisfactory quality.
Product availability may change, and certain products may be discontinued.
We reserve the right to update our product range and descriptions, provided that any changes affecting an existing order are handled in accordance with applicable consumer law.
SECTION 4 — ORDERS AND PURCHASES
When you place an order through our website, you are submitting an offer to purchase the selected products.
After placing an order, you will receive an acknowledgement or confirmation by email.
A purchase contract is formed when we accept your order through our order confirmation process.
We may decline an order before acceptance for legitimate reasons, including:
-
A product being unavailable.
-
An obvious pricing or listing error.
-
Payment authorisation problems.
-
Suspected fraudulent activity.
-
Delivery restrictions that prevent us from fulfilling the order.
If payment has been taken for an order that we cannot accept, we will arrange a full refund without undue delay.
If an issue arises after an order has been accepted, we will contact you to agree on an appropriate resolution in accordance with your legal rights.
If you need to correct an order or request cancellation, please contact us as soon as possible at cluethers@gmail.com.
Your statutory cancellation rights remain unaffected by the status of your order.
SECTION 5 — PRICES AND PAYMENT
All prices displayed on the Cluethers website are in British Pounds Sterling (GBP) unless otherwise stated.
The total price payable, including applicable taxes and mandatory charges, will be clearly presented before you complete your purchase.
Delivery charges will be displayed during checkout before payment.
We may change product prices or introduce promotions from time to time. Changes will not affect orders that have already been accepted, unless otherwise agreed with the customer in accordance with applicable law.
Payments are processed securely through Shopify and the payment providers made available at checkout.
We do not directly store complete credit or debit card numbers.
You must be authorised to use the payment method selected for your purchase.
If payment cannot be authorised, we may be unable to accept or process the order.
SECTION 6 — SHIPPING AND DELIVERY
Cluethers uses Royal Mail to deliver customer orders.
Our available delivery services, destinations, charges and estimated delivery times are explained in our Shipping & Delivery Policy.
Where offered, Royal Mail Tracked 48 aims to deliver within approximately 2–3 working days after dispatch.
Delivery estimates do not include the time required to prepare your order.
Delivery dates are estimates unless we have expressly agreed to a guaranteed delivery date or another binding delivery commitment.
We will deliver goods without undue delay and, unless a different period has been agreed, within 30 days after the contract is made.
Where a delivery is delayed or cannot be completed, customers may have statutory rights to require delivery within an additional appropriate period, cancel the contract or obtain a refund, depending on the circumstances.
Responsibility for Delivery
Cluethers remains responsible for the goods until they come into the physical possession of the customer or a person identified by the customer to receive them, subject to applicable legal exceptions.
If your order is lost, damaged during delivery or does not arrive, please contact us at cluethers@gmail.com.
We will investigate the matter and provide an appropriate resolution in accordance with UK consumer law.
For more information, please refer to our Shipping & Delivery Policy.
SECTION 7 — RETURNS, CANCELLATIONS AND REFUNDS
We want customers to feel confident when purchasing from Cluethers.
We offer a 30-day voluntary return policy, subject to the conditions explained in our Return & Refund Policy.
In addition, customers purchasing online generally have a statutory right to cancel within 14 days of receiving their goods, without providing a reason, subject to applicable exceptions.
After notifying us of a statutory cancellation, customers generally have a further 14 days to return the goods.
For a change-of-mind return, customers are responsible for the direct cost of return postage, provided the applicable legal requirements have been met.
If an item is faulty, damaged or not as described, Cluethers will cover the necessary or reasonable return costs as required by applicable UK law.
Our statutory cancellation and refund obligations, including reimbursement of eligible original standard delivery charges, are explained in our Return & Refund Policy.
For details about returns, refunds, exchanges, cancellation rights and applicable exceptions, please see our Return & Refund Policy.
Nothing in these Terms or our Return & Refund Policy restricts your statutory consumer rights.
SECTION 8 — CONSUMER RIGHTS AND PRODUCT QUALITY
All products sold by Cluethers must meet the requirements of applicable UK consumer protection legislation, including the Consumer Rights Act 2015.
Products must be:
-
Of satisfactory quality.
-
Fit for their intended purpose, where applicable.
-
As described.
If a product does not meet these requirements, you may be entitled to a refund, repair, replacement, price reduction or other remedy depending on the circumstances.
For qualifying faulty goods, consumers generally have a short-term right to reject within 30 days. Further statutory rights may apply beyond this period.
Any descriptions of natural leather characteristics, product-care recommendations or limitations of our voluntary return policy do not exclude these rights.
SECTION 9 — INTELLECTUAL PROPERTY
Unless otherwise stated, the original content of the Cluethers website, including our branding, photographs, written content, graphics and design elements, belongs to Cluethers or is used with appropriate permission.
Our original materials are protected by applicable intellectual property laws.
You may browse the website and use its content for personal, non-commercial purposes.
You must not copy, reproduce, distribute, commercially exploit or misuse our protected content without appropriate permission, except where permitted by law.
Names, logos and other materials belonging to Shopify or third parties remain the property of their respective owners.
Nothing in these Terms transfers ownership of intellectual property to customers.
SECTION 10 — THIRD-PARTY SERVICES AND LINKS
Our website uses Shopify and may contain links to third-party websites, platforms or services.
These may include payment providers, Royal Mail and social media platforms.
Third-party websites may operate under their own terms and privacy policies.
We are not responsible for the content or independent activities of websites that we do not control.
However, the involvement of a third-party provider does not remove Cluethers' legal responsibilities relating to products sold through our store.
SECTION 11 — RELATIONSHIP WITH SHOPIFY
Cluethers uses Shopify to host and operate its online store.
Purchases made directly through the Cluethers website are contracts between the customer and Cluethers, not between the customer and Shopify.
Cluethers is responsible for fulfilling orders, providing customer support and meeting its applicable consumer-law obligations.
Shopify may process certain information to provide payment, checkout and other e-commerce services.
Further information is available in our Privacy Policy and Shopify's applicable privacy notices.
SECTION 12 — PRIVACY AND PERSONAL INFORMATION
We respect your privacy and process personal information in accordance with applicable UK data protection legislation.
Our Privacy Policy explains:
-
What personal information we collect.
-
How and why we use it.
-
When information may be shared with service providers.
-
How information is protected.
-
How long information may be retained.
-
Your applicable data protection rights.
For more information, please refer to our Privacy Policy.
SECTION 13 — CUSTOMER REVIEWS AND FEEDBACK
Customers may choose to submit reviews, comments, suggestions or other feedback about Cluethers and its products.
By submitting a review for publication, you give Cluethers permission to display and reproduce that review in connection with our business, subject to applicable law and our Privacy Policy.
You confirm that your submitted feedback reflects your genuine experience and does not knowingly infringe another person's rights.
We may moderate or remove content that is unlawful, abusive, fraudulent, misleading or otherwise inappropriate.
We do not knowingly publish fabricated customer reviews or misrepresent customer feedback.
Where reviews have been incentivised, we will disclose this where required by law.
Submitting feedback does not remove any rights you have under applicable data protection or intellectual property legislation.
SECTION 14 — WEBSITE AVAILABILITY AND ACCEPTABLE USE
We aim to keep our website accessible, functional and secure.
However, temporary interruptions may occur due to maintenance, technical issues or circumstances beyond our reasonable control.
You agree not to use our website for unlawful, fraudulent or harmful purposes.
You must not attempt to interfere with the website's security, misuse customer information, introduce malicious software or gain unauthorised access to our systems.
We may take reasonable action to protect our website and customers against misuse.
Nothing in this section excludes liability that cannot legally be excluded.
SECTION 15 — ERRORS AND INFORMATION UPDATES
We make reasonable efforts to ensure that information on our website is accurate and up to date.
Occasionally, errors may occur in product descriptions, pricing, availability or other information.
If we identify an error before accepting an order, we may correct the information and contact you where necessary.
If an error affects an accepted order, we will explain the issue and seek an appropriate resolution without removing your statutory rights.
We may update our website content, product descriptions and future prices when necessary.
SECTION 16 — LIABILITY
Nothing in these Terms excludes or limits Cluethers' liability where doing so would be unlawful.
In particular, nothing excludes or restricts liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of statutory rights relating to goods.
-
Any other liability that cannot legally be excluded or restricted.
We are not responsible for losses arising solely from circumstances beyond our reasonable control where the law permits such a limitation.
Any limitations of liability in these Terms apply only to the extent permitted by applicable UK law.
Your statutory consumer rights remain unaffected.
SECTION 17 — CHANGES TO THESE TERMS
We may update these Terms of Service to reflect changes in our business, services, technology or applicable legal requirements.
The latest version will be available on our website.
Material changes will be communicated where required by law.
Changes to these Terms will not retrospectively remove or reduce rights arising under orders already accepted.
SECTION 18 — GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the customer's place of residence.
Nothing in these Terms removes any mandatory rights a consumer may have under applicable law.
If you have a complaint regarding a product, order or service, please contact us first so that we can try to resolve the matter.
Customers may bring legal proceedings in the courts available to them under applicable consumer law.
